SASTU criticized the new seafarers' diploma scheme
PWTTU does not support the project on the rank of commanding officers of maritime vessels. A corresponding appeal was published about it.
On May 2, 2022 the Ministry of Infrastructure of Ukraine published for discussion the draft resolution of the Cabinet of Ministers of Ukraine "On Approval of the Regulation on the Title of Officers in Command of Maritime Vessels and Procedure for their Assignment and Some Issues of Training and Qualification of Seafarers".
The Maritime Administration of Ukraine notes that there are positive changes in the draft Regulation. For example, that conditions of seafarers' qualification will be brought in accordance with STCW-78 Convention as amended. But at the same time the Draft Provision contains critical remarks on organization of seafarers' qualification assessment process and issue of qualification documents. The norms of the Draft are aimed at fixing the current processes, which contains the signs of corruption risks. Namely:
It is not determined which electronic system will be provided to the seafarers. Also, the order and conditions of the system and the requirements for information security in it are not prescribed; The draft Provisions determine that the CES testing system will be used in the framework of the implementation of the pilot project; The Draft Provision increases the legal uncertainty of the State Qualification Commission for Seafarers, thereby increasing the influence of the "human" factor; the draft does not define the primary qualification requirements for the selection of candidates for the position of Chairman or member of the SSC; The Draft Regulation also does not define the responsibility of the seafarer's SCC members who have taken an unreasonable decision in respect of a seafarer; The ineffective and non-transparent system of appealing against the decisions of the Seafarers' SCC is completely preserved. Also the PRMTU was informed that the development of the new electronic system has been stopped. Therefore, the only service is the mobile application "Seafarer's e-Cabinet", the use of which in the future is categorically unacceptable.
FSRMTU considers it necessary to ensure the continued use of certified independent systems for assessing the qualifications of seafarers, because the use of the CES testing system has already proven its effectiveness.
The Draft Provision does not specify the list and form of documents to be drawn up based on the results of the seafarer's application and the SCC's work, the form of the SCC's consideration of the seafarers' applications (meeting or other form), conditions and procedure for forming the membership of each particular SCC to consider the seafarer's application, and the procedure for signing a decision on refusal to issue a seafarer's qualification document.
Adoption of the Draft Regulation in the proposed wording will have critical consequences and will lead to the termination of the seafarers' qualification assessment system as well as the violation by Ukraine of its international obligations.
